Dance Ontario Association has now completed discussions with Re:SOUND regarding that organization’s updated Tariff 6b covering use of music for teaching. Fees for 2015 and 2016 should be calculated by multiplying $0.348 x the number of classes per year*.

RE:SOUND will offer Dance Ontario members coverage from  2008 to 2016, provided that:

  • reporting directly to RE:SOUND for classes held during the period of January 1, 2015 to December 31, 2015, is received no later than November 30, 2016.
  • reporting directly to RE:SOUND for classes held during the period of January 1, 2016 to December 31, 2016, is received no later than January 31, 2017.
  • payment for classes held during the period of January 1, 2015 to December 31, 2015 is received no later than December 30, 2016.
  • payment for classes held during the period of January 1, 2016 to December 31, 2016 is received no later than January 31, 2017.

If reporting and payment for the 2015 and 2016 are not received by the dates specified above, reporting and payment for periods starting January 1, 2008 to December 31, 2016 will be due immediately.

Basically if member studios complied with the above, RE:SOUND would forgive years 2008 – 2014.  Tariff 6.B would not however be reduced from the formula indicated on their website. In addition, we understand that a basic fee of $50 annually will shortly be imposed for those studios that play music between classes or  in reception areas.

Studios that have been remitting approx $23+ annually  from 2008 – 2014 would NOT be liable for the $0.348 per class per year for the earlier period but do need to remit for 2015 and 2016.

*For studios that offer RAD syllabus classes, please note that these would be EXEMPT from fees. RE:SOUND asks that studios advise them if they only teach syllabus classes in order for them to adjust their records accordingly.

Re:Sound Music Licensing Company is the organization in Canada that administers the rights of artists and record labels in respect of the public performance and telecommunication of their sound recordings. Re:Sound collects royalties on behalf of artists and record companies pursuant to tariffs certified by the Copyright Board of Canada.

Re:Sound Tariff No. 6.B, The Use of Recorded Music to Accompany Fitness Activities was certified by the Copyright Board of Canada on July 7, 2012 for periods returning to 2008. Tariff 6.B sets out when and how businesses are required to obtain a licence from Re:Sound for the use of recorded music to accompany fitness and dance instruction, skating, and other such physical activity.
